The Core Architecture of Data Principal Rights

India's Digital Personal Data Protection Act, 2023 (DPDPA) centers on empowering the individual (the 'Data Principal'). Sections 11 through 14 grant four fundamental statutory rights that Data Fiduciaries must actively support through accessible operational and technical workflows.

Failing to respect these rights or ignoring grievance requests exposes Data Fiduciaries to significant regulatory scrutiny and financial penalties from the Data Protection Board of India.

The Four Statutory Rights (Sections 11–14)

1. Right to Access Information (Section 11)

Data Principals have the right to request a concise summary of the personal data being processed, the specific processing activities undertaken, and the identities of all other Data Fiduciaries and Data Processors with whom their data has been shared.

2. Right to Correction and Erasure (Section 12)

Data Principals may request correction of inaccurate data, completion of incomplete records, updating of obsolete information, and complete erasure of personal data that is no longer necessary for the purpose for which it was collected.

3. Right of Grievance Redressal (Section 13)

Data Fiduciaries must establish an easily accessible grievance redressal mechanism. The Data Principal must exhaust this internal mechanism before approaching the Data Protection Board of India.

4. Right to Nominate (Section 14)

Every Data Principal has the right to nominate another individual who, in the event of their death or mental/physical incapacity, shall exercise their data protection rights.

Operational Fulfillment Workflow for Indian Enterprises

1

Identity Verification

Authenticate that the individual making the rights request is indeed the lawful Data Principal, without collecting excessive additional personal data.

2

Data Discovery Across Systems

Query internal databases, third-party CRMs, and email archives to assemble the complete data footprint associated with the individual.

3

Fulfillment & Processor Orchestration

Execute the requested action (erasure, correction, or data export) and notify downstream processors to mirror the update.

4

Audit Logging

Record the request, verification timestamp, fulfillment action, and notification proof in an append-only compliance ledger.

Frequently Asked Questions

Can a Data Fiduciary charge a fee to fulfill a Data Principal rights request?

Under DPDPA 2023 and the notified rules, Data Fiduciaries are expected to provide access to information and basic rights fulfillment without levying prohibitive fees, maintaining accessibility for all citizens.

What are the statutory grounds to refuse an erasure request under Section 12?

An erasure request may be refused if the personal data is strictly necessary for legal compliance, regulatory retention mandates (e.g. tax laws, AML/KYC rules), or defending legal claims.

What is the response timeline for resolving grievances under Section 13?

Data Fiduciaries must resolve grievances within the period specified by the notified DPDP Rules (typically within 30 days) to prevent escalation to the Data Protection Board.
